Terms of Service

These Terms of Service ("Terms") govern your use of software, services, websites, and related materials provided by Mythetech ("we," "us," or "our"). By downloading, installing, accessing, or using any Mythetech product or service (collectively, the "Software"), you agree to be bound by these Terms. If you do not agree, you must not use the Software.
2. Description of Software
Mythetech develops and distributes desktop applications, web applications, frameworks, and developer tools. Some Software is provided free of charge under open-source licenses, while other Software is offered under commercial license terms. The specific license governing each product is identified in its documentation or on its product page.
3. License
Your use of any Mythetech Software is subject to the applicable license agreement for that product. Commercially licensed Software, including Hermes, is governed by the Mythetech Commercial Software License Agreement. Open-source Software is governed by the license specified in the applicable repository. Nothing in these Terms grants rights beyond what is provided in the applicable license.
4. Beta and Pre-Release Software
Mythetech may make beta, preview, early access, or pre-release versions of Software available ("Beta Software"). Beta Software is provided for evaluation and testing purposes and may contain bugs, errors, or incomplete features. Beta Software is provided "as is" without any warranty of any kind. We may discontinue, modify, or limit access to Beta Software at any time without notice. You acknowledge that Beta Software may not be suitable for production use and that you use it at your own risk.
5. Use Restrictions
You agree that you will not:
- Use the Software for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the Software or related systems or networks.
- Reverse engineer, decompile, or disassemble commercially licensed Software, except as expressly permitted by applicable law.
- Remove, alter, or obscure any proprietary notices, labels, or markings on the Software.
- Redistribute, sublicense, or transfer commercially licensed Software except as permitted by the applicable license agreement.
6. Intellectual Property
Mythetech retains all rights, title, and interest in and to the Software, including all intellectual property rights. Except for the limited rights expressly granted under the applicable license agreement, no rights are granted to you. You may not use our trademarks, logos, or other proprietary information without our prior written consent.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MYTHETECH DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR DATA WILL BE SECURE OR NOT OTHERWISE LOST OR DAMAGED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYTHETECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF MYTHETECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MYTHETECH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SOFTWARE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO MYTHETECH IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify, defend, and hold harmless Mythetech and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Software or your violation of these Terms.
10. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information when you use the Software.
11. Termination
These Terms are effective until terminated. We may terminate or suspend your access to the Software at any time, without prior notice or liability, if you breach these Terms. Upon termination, you must cease all use of the Software and destroy any copies in your possession, except as permitted by the applicable license agreement.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Washington, D.C., for the resolution of any disputes arising out of these Terms or your use of the Software.
13. Changes to Terms
Mythetech reserves the right to modify these Terms at any time. Material changes will be communicated through our website or other reasonable means. Your continued use of the Software after any changes constitutes your acceptance of the updated Terms.
